casitahomes.com (“Casita,” “we,” “us,” or “our”) is owned and operated by CasitaMX Enterprises, Inc., a Delaware corporation. Casita provides software tools that help people discover vacation rentals and, where applicable, connect directly with property hosts or owners to book stays. Some listings on casitahomes.com may allow direct bookings, while others link to external partner or host websites managed independently by those parties.
Casita is not a rental agent, broker, property manager, payment processor, or intermediary. casitahomes.com is not an OTA (Online Travel Agency).
By accessing or using casitahomes.com, you (“User,” “Host,” or “Guest”) agree to these Terms of Service (“Terms”). If you do not agree, do not use the platform.
Casita provides technology that allows users to discover accommodations and, where applicable, connect with hosts or follow external links to third-party or host-managed booking sites. Casita does not own, operate, or manage any of the properties listed on casitahomes.com. Casita is not a party to any agreement between Hosts and Guests and does not control the terms, pricing, or conditions of any stay.
Some listings may include direct messaging or booking functionality within casitahomes.com, while others redirect to third-party or host websites. Casita does not guarantee the accuracy, availability, or reliability of any external website and is not responsible for their terms, content, or privacy practices.
We do our best to feature reliable and trustworthy properties, but we cannot verify every listing, host, or external link beyond a reasonable level. You use the platform at your own risk.
You must be at least 18 years old and able to form legally binding contracts to use casitahomes.com. By using the site, you represent that you meet these requirements.
Hosts may create free accounts to list properties and manage bookings. Initial use of the platform is free, but Hosts may only accept a limited number of direct reservations before upgrading to a paid plan. Certain premium features may also require a subscription. Casita reserves the right to modify or discontinue any plan or feature at any time with reasonable notice.
Guests use casitahomes.com to discover vacation rentals and connect with Hosts. Guests do not pay Casita to use the platform. Casita is not responsible for the accuracy, completeness, or legality of listings, nor for cancellations, refunds, damages, or any aspect of a stay. All arrangements, communications, and payments—whether made through casitahomes.com or on an external partner or host website—are strictly between the Host and Guest.
Casita does not collect, process, or hold payments on behalf of Hosts or Guests. When a booking occurs, it may happen directly between the parties or via a third-party or host-managed platform. Casita is not liable for any failed, fraudulent, delayed, or disputed payments, or for issues arising from external payment systems.
Hosts may upload content such as property descriptions, photos, videos, or logos (“User Content”). By uploading, you grant Casita a non-exclusive, worldwide, royalty-free license to display and promote that content on the platform.
Casita retains ownership of all software, trademarks, and materials on casitahomes.com. Users may not copy, modify, reverse-engineer, distribute, or resell any part of the platform.
You agree not to use casitahomes.com for unlawful purposes, to create false or misleading listings, infringe on others’ rights, upload malicious code, or attempt to scrape or disrupt Casita’s systems. Casita may suspend or terminate accounts violating these Terms.
casitahomes.com may include links to third-party or host-managed websites for informational or booking purposes. These links are provided for convenience only. Casita does not endorse, control, or assume responsibility for any third-party site, its content, terms, or privacy practices. Accessing or using third-party sites is at your own risk.
casitahomes.com is provided “as is” and “as available.” Casita makes no warranties—express or implied—regarding the accuracy of listings, the availability of the platform, or the suitability, safety, or legality of any property. Use of casitahomes.com is at your sole risk.
To the maximum extent permitted by law, Casita and its affiliates, directors, officers, and employees are not liable for any indirect, incidental, or consequential damages, including loss of profits, goodwill, or data, or for any issue arising from Host-Guest interactions, bookings, stays, or third-party websites. In all cases, Casita’s total liability shall not exceed the greater of one hundred dollars ($100 USD) or the amount paid by you to Casita in the twelve months preceding the claim.
You agree to indemnify and hold harmless CasitaMX Enterprises, Inc., its affiliates, and employees from any claims, damages, or expenses (including legal fees) arising from your use of casitahomes.com or violation of these Terms.
All disputes arising out of or relating to these Terms or your use of casitahomes.com shall be resolved exclusively by binding arbitration administered by the American Arbitration Association (AAA) under its rules. Venue shall be Wilmington, Delaware, USA, and proceedings shall be in English. Each party bears its own costs unless otherwise required by law. You waive any right to a jury trial or class action.
These Terms are governed by the laws of the State of Delaware, excluding its conflict-of-law principles.
Casita may update these Terms periodically. The Effective Date above reflects the most recent revision. Continued use of casitahomes.com after updates constitutes acceptance of the revised Terms.
