Preamble

Welcome to Casita. "Casita," "we," "us," and "our" mean CasitaMX LLC, a Wyoming limited liability company with its principal place of business at 8737 Colesville Rd, Ste 1101, Silver Spring, MD 20910, United States. "Casita" is used in these Terms of Service as a shorthand reference to CasitaMX LLC only.

We provide the Casita Services described below subject to these Terms of Service (the "Terms").

Because this page contains legal obligations — including limitations on liability, an arbitration provision, and a class action waiver — please read it fully and with care. By accessing Casita and using the Services, you agree to be bound by these Terms and by our Privacy Policy, available at https://casitahomes.com/documents/privacy-policy, unless separate terms are offered by you in writing and accepted in writing by an authorized officer of Casita.

We reserve the right, in our sole discretion, to change these Terms at any time by posting revised terms to https://casitahomes.com (the "Website"). The revised Terms take effect on publication. We may, but are not required to, give additional notice of a change by email or through your account. Your continued use of or access to Casita following publication constitutes acceptance of the changes. Changes do not apply retroactively to reservations already confirmed before the effective date.

When using the Services you are also subject to the guidelines, policies, and rules we publish and make applicable to them, as in effect from time to time, each incorporated into these Terms by reference. These include our Privacy Policy, the cancellation policy displayed on each Property Listing and repeated in your booking confirmation, our community and guest safety standards, our non-discrimination standards, and the terms presented to travel agents at the time of application and in the travel agent dashboard. Where a published policy conflicts with these Terms, these Terms control.

PLEASE NOTE: The Casita Services are available only to persons eighteen (18) years of age or older. We do not knowingly collect or solicit personally identifiable information from anyone under 18. If we learn that we have collected personal information from a person under 18, we will delete it as quickly as reasonably possible. If you believe a person under 18 has provided us with personal information, contact us at [email protected].

1. Definitions

  • "Guest" — any person who searches for, requests, books, or stays at a Property Listing through the Services, and any guest or occupant accompanying them.

  • "Host" — an individual or entity that owns a property, or is authorized by the owner to market and rent it, and that offers it on the Services.

  • "Property" or "Property Listing" — a property listed on the Services, and the listing that describes it.

  • "Travel Agent" — a person or entity accepted into the Casita travel agent partner program under Section 8.

  • "Services" or "Casita Services" — the Casita websites, mobile applications, APIs, booking and payment infrastructure, and any successor or additional channels through which Casita markets properties, whether Casita-branded, co-branded, or white-labeled.

  • "Content" — all information, data, text, software, sound, photographs, graphics, video, messages, and other materials made available through the Services.

  • "Property Rules" — the house rules, requirements, and posted policies applicable to a given Property Listing.

  • "Cancellation Policy" — the cancellation and refund policy that applies to a Property Listing, as displayed on that listing at the time of booking and repeated in the booking confirmation.

  • "Booking Agreement" — any separate booking agreement, rental terms acknowledgment, payment authorization, or similar document that Casita presents to you for acceptance in connection with a particular reservation.

Section references are to Sections of these Terms. Headings are for convenience only.

2. Limited License

Subject to these Terms and your compliance with them, Casita grants you a limited, revocable, non-exclusive, non-transferable license to access the Website and the Content and Services on it, solely to advertise or rent a rental property, to advertise or rent from commercial lodging establishments, or for any other purpose clearly stated on the Website.

Any other use of the Website — including republication, scraping, automated data collection, use of the Content to train any machine learning or artificial intelligence model, or any commercial use — is expressly prohibited unless authorized by us in writing.

3. Our Service

Casita operates an online marketplace where Hosts offer Property Listings and Guests search for and book accommodations. Casita provides only two services: the online marketplace, and payment processing for reservations made through the marketplace.

Casita does not own, operate, manage, inspect, control, or supervise any Property. Casita is not a host, lodging provider, landlord, insurer, travel agent, or organizer or retailer of travel packages. Reservations made through the Services are contracts between the Guest and the Host. Casita is not a party to that contract.

All information about accommodations on the platform originates with the Host. Casita does not endorse any Host. The Host is at all times responsible for the information in its Property Listing. Casita cannot review or guarantee that this information is accurate and is not responsible for any error or omission in it.

Display, ranking, sorting, inclusion, translation, formatting, and merchandising of listings are at Casita's sole discretion. Casita may modify, redesign, add to, suspend, or discontinue any part of the Services at any time without notice and without liability.

You understand that the Services are provided on an "AS IS" basis, and that each Host is solely responsible at all times for the quality, condition, safety, cleanliness, habitability, and legality of the accommodation, and for the accuracy of the listing information, including rates and availability.

Although Casita provides payment processing, we are not responsible for the payment solutions themselves. In particular, we are not responsible for any decision by a payment provider to decline your payment.

Optional features and programs. Where these Terms describe a feature, program, product, tool, or service that Casita may make available — including any verification or screening process, any security deposit facility, any damage protection or damage waiver product, any tax collection or remittance function, any referral or partner program, and any additional service arranged with a Host — Casita offers it at its sole discretion. Casita does not undertake to offer it, does not represent that it is available in any market or for any booking, Property, or user, and may introduce, modify, limit, suspend, or withdraw it at any time and without notice or liability. No Guest, Host, or Travel Agent may rely on the availability of any such feature or program, and its description in these Terms creates no obligation on Casita and no right or entitlement in favor of any other person.

4. Account, Contact Information, Passwords, and Security

You may be required to create an account, select a username and password, and provide certain information in order to use the Services.

You are responsible for maintaining the confidentiality of your account credentials and are fully responsible for all activity under your account. You agree to (a) immediately notify Casita of any unauthorized use of your password or account or any other breach of security, and (b) exit your account at the end of each session. Casita will not be liable for any loss or damage arising from your failure to comply with this Section.

Electronic, SMS, and messaging communications. You may receive communications from Casita by email, SMS, or WhatsApp. By signing up for the Services and providing your mobile number, you confirm that you want Casita to send you information about your account and your use of the Services, which may involve automated dialing or messaging technology. You represent that each person you register, or for whom you provide a mobile number, has consented to receive communications from Casita.

Message and data rates may apply. You may opt out of promotional messages at any time by replying STOP, or request help by replying HELP. Transactional messages relating to an active reservation may continue after opt-out where necessary to service that reservation.

You agree to indemnify and hold Casita harmless from any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising from your breach of this Section.

Termination by you. You may close your account at any time by written notice to [email protected]. No refund for unused Services will be given. Closing your account does not affect confirmed reservations, which remain governed by the applicable Cancellation Policy.

5. Guest Obligations

In consideration of your use of the Services as a Guest, you agree to:

(a) provide true, accurate, current, and complete information about yourself as prompted by the registration form or by Casita's representatives ("Profile Data"); (b) maintain and promptly update your Profile Data to keep it true, accurate, current, and complete; (c) abide by all applicable Property Rules and by our community and guest safety standards; (d) not exceed the maximum occupancy stated in the Property Listing, and accurately disclose the number of occupants; (e) treat the Property, its contents, and its neighbors with care and respect, and comply with applicable homeowners' association, condominium, and local noise and nuisance rules; and (f) not use a Property for any event, party, photoshoot, commercial filming, or other non-residential purpose without the Host's prior written approval, which may carry an additional charge.

If you provide information that is untrue, inaccurate, not current, or incomplete — or if Casita has reasonable grounds to suspect that it is — or if you violate any Host's Property Rules, we may suspend or terminate your account and refuse any current or future use of the Services.

As a Guest you agree to adhere to the posted policies and house rules for any booking, and acknowledge that failing to do so voids the contract for that booking.

Damage. You are responsible for any damage you or your occupants or visitors cause to a Property or its contents, and for any resulting loss to the Host. Any security deposit, damage claim, or incidental charge is a matter between you and the Host. Casita has no obligation to adjudicate, collect, guarantee, or fund any such claim, and does not act as an insurer, underwriter, or adjuster. Where Casita facilitates the collection of such a charge through the platform, it does so as a convenience only, and you authorize Casita to charge your payment method for amounts the Host is entitled to recover.

Casita may, but is under no obligation to, make available a security deposit facility, or a damage protection, damage waiver, or similar product offered by a third party. Any such facility or product is optional, is provided on the third party's own terms, may be offered to some bookings, Properties, or users and not others, and may be introduced, changed, or withdrawn at any time in Casita's sole discretion. Where a third-party product is made available, Casita is not the insurer, underwriter, or provider of it, does not guarantee that it exists, applies to your booking, or covers any particular loss, and is not responsible for any decision made under it. Nothing in this paragraph limits your responsibility for damage or the Host's right to recover it.

6. Host Obligations

Hosts contract with Casita under a separate Host Partnership Agreement. In the event of any conflict between these Terms and that agreement with respect to a Host's rights and obligations, the Host Partnership Agreement controls. In summary, and without limiting that agreement, each Host is solely responsible for:

  • fulfilling every confirmed reservation, and for all guest service before, during, and after the stay;

  • the condition, safety, cleanliness, legality, and habitability of each Property, including all legally required safety devices;

  • the accuracy and currency of all listing information, including photographs, rates, availability, amenities, Cancellation Policy, and Property Rules;

  • holding and maintaining all permits, licenses, registrations, and approvals required to operate the Property as short-term accommodation, and complying with all applicable laws, tax obligations, land-use restrictions, and homeowners' association and condominium rules;

  • maintaining, at its own expense, insurance adequate to cover its ownership and operation of the Property as short-term accommodation, including liability for bodily injury and property damage suffered by Guests and third parties; and

  • complying with all applicable fair housing, anti-discrimination, and civil rights laws, and not discriminating against Guests on any basis prohibited by applicable law or by our non-discrimination standards.

Hosts agree not to attempt to circumvent the commission due to Casita, including by providing off-platform contact information, offering incentives for direct booking, or directing a Guest to another booking channel.

Casita may refuse to list, may remove, and may downrank or suspend any Property at any time, for any reason, without liability. Casita may also terminate a confirmed booking or a listing where it obtains information that may compromise Guest safety.

Casita does not verify licensing, permits, safety features, insurance, or property conditions, gives no advice on what applies to a Host, and makes no determination on the subject.

7. Booking Process

Casita supports two booking methods. Which one applies is shown on the Property Listing.

7.1 Instant Booking

Where a Property is offered as "Instant Booking," you will be prompted to enter your credit card or other payment method when making a reservation. Casita may verify and/or pre-authorize those details. Because Instant Booking confirms reservations without delay, charges are applied immediately.

By making an Instant Booking you agree to these Terms, to the applicable Cancellation Policy, and to the Property Rules set by the Host.

7.2 Booking Request

Where a Property is offered by request, you must enter your credit card or other payment method, which may be verified and/or pre-authorized by Casita. You will not be charged until the Host confirms the reservation. The reservation remains pending until then, which may happen immediately or, in some cases, may take more than 48 hours.

By submitting a Booking Request you agree to these Terms, to the applicable Cancellation Policy, and to the Property Rules set by the Host.

7.3 Host Response

The Host will either confirm or decline your Booking Request. All communication about the details of the stay must take place through the Casita platform. Where appropriate, the Host may present a revised offer with different dates, rates, or an alternative property.

Hosts may decline any reservation without liability to the Guest. All accommodations are independently owned, and a Host may decline animals or may restrict occupancy by children where necessary for health or safety reasons consistent with applicable regulations. This discretion does not permit discrimination: every Host is contractually required to comply with applicable fair housing, anti-discrimination, and civil rights laws, and not to discriminate on the basis of sexual orientation, gender identity, race, religion, ethnicity, disability, or nationality.

A Booking Request remains subject to acceptance by the Host until confirmed, and no charge is applied unless and until the Host confirms it. Casita may permit you to withdraw a pending Booking Request but is not obligated to do so. Casita does not guarantee that a Host will respond to a Booking Request, or that it will respond within any particular time. Some Cancellation Policies allow a 24-hour free cancellation window after Host confirmation, provided you are outside the policy's refund cutoff. Whether such a window applies to your reservation, and its length, is determined by the Cancellation Policy applicable to that Property Listing.

Both parties acknowledge that a Booking Request is not a confirmed reservation, and that the Host is not obligated to make the accommodation available until the reservation is confirmed.

7.4 Confirmation

Once a reservation is confirmed, we will share with the Host only the information we determine is necessary to fulfil the booking, and the Host may use it solely to fulfil and service that booking. As between Casita and the Host, Casita controls all Guest data collected through the Services, and its handling is governed by our Privacy Policy.

Upon confirmation, the Host is obligated to allow you to occupy the accommodation on the confirmed dates, and you agree to pay in full the total reservation amount, including any service fee, which will be charged to the payment method on file.

A confirmed reservation is a binding agreement between the Host and the Guest. Casita is not a party to it. Casita serves only to list and display accommodations, manage reservations, accept and process payments from Guests as the Host's limited payment collection agent, and remit those payments to the Host after deducting its commission and any other amounts owed. Payment by you to Casita discharges your payment obligation to the Host in full, whether or not Casita subsequently remits to the Host.

Where Casita determines that a cancellation was unnecessary and the direct result of the Host's own actions — for example, a double booking — Casita may invoice the Host for the resulting administrative costs.

Booking Agreement as a condition. Casita may require you to accept a Booking Agreement as a condition of a reservation, whether before or after the reservation is confirmed and whether before or after any payment is taken. Where Casita does so and you do not accept the Booking Agreement by the time Casita specifies, Casita or the Host may cancel the reservation, and any refund is governed by the applicable Cancellation Policy. Acceptance of a Booking Agreement does not replace these Terms, which continue to apply in accordance with Section 29.

8. Travel Agent Partner Program

Casita operates a partner program under which qualified travel agents and agencies may book eligible stays for their clients and earn a commission. Participation requires application and acceptance, and is subject to the program terms presented at the time of application and in the travel agent dashboard, which are incorporated by reference. In summary:

  • A Travel Agent must be duly registered or licensed as required in its jurisdiction and must accurately represent its agency and its authority to act for a client.

  • The Travel Agent is responsible for ensuring that each client has been informed of, and agrees to, these Terms, the applicable Cancellation Policy, and the applicable Property Rules before the booking is made. The client remains the Guest for all purposes under these Terms.

  • Commission is payable only on eligible, completed stays, at the rate and on the schedule stated in the program terms, and is not payable on cancelled, refunded, chargeback-affected, or fraudulent bookings. Casita may set off unearned or clawed-back commission against future amounts payable.

  • Casita may change commission rates, eligibility criteria, or the program itself at any time, and may suspend or terminate any Travel Agent account for misuse, misrepresentation, or breach of these Terms.

  • A Travel Agent may not represent itself as an agent, employee, or authorized representative of Casita, and may not make representations about a Property beyond the information published in the Property Listing.

9. Additional Services Arranged with Hosts

Some Hosts offer extra services to enhance a stay, such as guided tours, chef or breakfast service, spa treatments, childcare, or private transportation. These are offered at the Host's discretion and are arranged between the Guest and the Host.

A Host offering such a service must describe it clearly, including all associated costs, and the price and cancellation terms must be agreed between the Guest and the Host before the service is provided. Where Casita facilitates payment for such a service, a service fee may apply.

Casita is not responsible for the provision, quality, or safety of these services. Any dispute must be resolved directly between the Guest and the Host. Casita will not be liable for any issue arising from them. Hosts offering such services must comply with applicable local regulations and safety standards, and Casita may remove any listing or service that violates applicable law.

10. Homes for Sale and Real Estate Referrals

Casita may display information about properties offered for sale. Casita is not a licensed real estate broker or agent in the United States, in Mexico, or in any other jurisdiction, and does not provide brokerage, appraisal, escrow, legal, tax, or investment services.

Any for-sale listing is displayed for informational purposes only, is based on information supplied by the owner or its representative, and is not an offer, a solicitation, or a representation regarding title, condition, zoning, permitting, valuation, or the capacity of any purchaser to acquire the property. Acquiring real estate in Mexico may involve additional requirements, including restrictions applicable to foreign buyers in restricted zones and the use of a fideicomiso (bank trust) or a Mexican company. You must retain your own qualified legal, tax, and brokerage advisors. Casita disclaims all liability arising from any real estate transaction introduced through the Services.

Where Casita receives compensation in connection with an introduction, it will disclose that compensation to the extent required by applicable law.

11. Fees, Payment, and Refunds

11.1 Payment processing

We use one or more third-party payment processors to bill you through a payment account linked to your account on the Services. Processing is subject to the terms, conditions, and privacy policies of the applicable processor in addition to these Terms. The processor handling your transaction is identified at checkout, and its terms are made available to you at that time.

We are not responsible for any error, act, or omission of a payment processor. By using the Services you agree to pay us, through the processor, all charges at the prices then in effect for your use of the Services, and you authorize us, through the processor, to charge your chosen payment provider. We may correct any error or mistake made by a processor, even if payment has already been requested or received.

11.2 Guest service fee

Casita may charge a service fee on reservations and on additional services booked through the platform. The amount of the fee is determined by Casita in its sole discretion and may vary by booking, market, channel, and party. Many bookings carry no service fee. Where no fee is charged on a booking, that does not waive Casita's right to charge one on any other booking, and creates no expectation that future bookings will be free of it. The fee, where charged, may be presented separately or included within the total shown to you. Value added tax is added to the fee where applicable. Modifying a booking may result in additional fees or credits.

11.3 Host commission

Casita charges Hosts a commission on confirmed reservations, assessed at the time of confirmation and deducted from booking proceeds. The commission is a matter between Casita and the Host under the Host Partnership Agreement and does not create any right or obligation for Guests.

11.4 Fee changes

Casita may change its fees at any time before a reservation is confirmed. Continued use of the Services after a fee change constitutes acceptance of it. A fee change does not apply retroactively to reservations already confirmed.

11.5 Cancellations and refunds

Guest-initiated cancellations. Refunds are governed by the Host's Cancellation Policy as displayed on the Property Listing at the time of booking and repeated in your confirmation. The reservation amount is refunded according to that policy. The Casita service fee is adjusted in proportion to the amount refunded.

Host-initiated cancellations. Where a Host cancels, Casita may conduct an internal review. Depending on the circumstances and the outcome of any such review, the Host may be held responsible for refunding your full payment, including our service fee and commission. This is determined case by case in Casita's sole discretion, and Casita reserves the right to decide whether any such refund applies. Nothing in this paragraph entitles you to a review, to a particular outcome, or to any refund beyond what the applicable Cancellation Policy provides.

Discretionary adjustments. Casita may, at its sole discretion, issue a refund, credit, or goodwill payment where it determines that a Guest experienced an issue with a stay, or where required by law, by our policies, or by a payment network rule. Any such adjustment is a commercial service-recovery measure only. It is not an admission of liability by Casita or by any Host, does not determine fault, and creates no right or entitlement in favor of any Guest.

11.6 Guest payment authorization

You represent that you have the legal right and authority to use the payment method you provide and to authorize Casita to charge it in accordance with these Terms.

You authorize Casita and its payment processors to charge your payment method in the amount you authorized through the Services, which may include amounts owed to the Host, any taxes Casita is obligated to collect on behalf of a governmental authority, our service fee, and any charge you have authorized under Section 5 in respect of damage. You also authorize the crediting or debiting of your payment method in connection with any service fee, chargeback, refund, reversal, or adjustment. On request, you agree to sign and submit a direct debit mandate or other applicable bank form allowing Casita to debit your account for amounts owed.

11.7 Chargebacks

Casita recognizes that chargebacks occur for valid reasons. However, if you make a payment-card payment through Casita and later dispute it by asserting a chargeback without merit, as determined in our reasonable discretion, whether fraudulently or otherwise, we may take steps to recover the resulting charges from you directly.

Chargebacks without merit include disputing a charge made in accordance with the Host's Cancellation Policy; disputing a charge where you failed to make reasonable efforts to work with the Host or with us to resolve the underlying issue; disputing a charge for a reservation you and the Host modified in breach of these Terms; and requesting a chargeback without a legitimate reason or without providing information sufficient to allow the request to be assessed.

We reserve the right to recover such amounts by any lawful means, including through a third-party debt collection agency.

11.8 Collections

If you fail to pay the total reservation amount or any other amount due to Casita, whether directly or in our capacity as the Host's agent, we may initiate a collection action without limiting our other remedies. In that event you agree to pay all costs and expenses, including reasonable attorneys' fees, incurred by or on behalf of Casita in connection with it.

11.9 Currency and exchange rates

Casita normally displays reservation amounts in the Host's local currency, and may also display amounts in a currency you select for convenience. Where it cannot do so it will display amounts in U.S. dollars. The currency actually charged is identified at checkout.

Exchange rates shown for display purposes are indicative and update periodically. Card issuers and payment processors may impose currency conversion fees, and the rate applied by your issuer may differ from the rate displayed. Casita disclaims responsibility for any such fee or rate difference.

12. Taxes

All amounts stated on the Services are exclusive of taxes unless expressly stated otherwise. Each party is responsible for its own taxes.

Hosts are solely responsible for determining, calculating, collecting, reporting, filing, and remitting all taxes arising from their properties and from any stay, to the applicable authorities. Casita provides no tax, legal, accounting, or regulatory advice, and nothing on the Services or communicated by Casita or its personnel constitutes such advice or may be relied on as such. No party may assume that any tax obligation has been satisfied because a payment was processed through the Services.

Where a Host is required to collect a lodging, occupancy, or similar tax from a Guest, that tax is the Host's to determine and collect, and whether it is included in the displayed rate is set by the Host in its listing.

Casita may collect, withhold, report, or remit taxes in connection with a booking, either at its discretion or where required to do so, and may require tax identification, residency, or registration information as a condition of processing a payment or releasing a payout. Casita does not undertake to do so. It makes no representation that it collects, withholds, reports, or remits any tax for any booking, market, Property, or party, and may begin, change, limit, or cease doing so at any time without notice. Where Casita collects an amount described as tax, it does so only in the amount and manner it determines.

No Host or Guest may treat any tax obligation as satisfied, or as unsatisfied, because Casita processed a payment, collected or did not collect an amount described as tax, or remitted or did not remit any amount.

Guests are responsible for any tax consequences of their own use of the Services.

13. Identity Verification, Screening, and Security

As part of the booking and payment process, Casita, its payment processors, and any third-party provider it engages may verify your identity and payment method, screen transactions for fraud and chargeback risk, and screen users against sanctions and watchlists. Casita may decline, suspend, or cancel any booking, and may suspend or close any account, on the basis of any such check.

Any verification or screening is entirely discretionary. Casita does not represent, warrant, or guarantee that any verification or screening has been performed, is performed, or will be performed, whether generally or in respect of any particular booking, Guest, Host, Travel Agent, or Property. Casita may introduce, change, limit, or discontinue any verification or screening process at any time without notice. No Guest or Host may rely on the existence, scope, or outcome of any such process, and no such process is a representation about the identity, conduct, creditworthiness, or suitability of any person.

Casita may also require verification of a Host's identity, ownership, beneficial ownership, banking details, or sanctions status, and may suspend payouts pending that verification.

Personal data collected in connection with verification and screening is handled in accordance with our Privacy Policy and applicable data protection law.

Sanctions. You represent that you are not, and are not acting on behalf of, any person or entity that is named on any sanctions list maintained by the U.S. Office of Foreign Assets Control, the United Nations, the European Union, or the United Kingdom, or that is located in, organized under the laws of, or ordinarily resident in a comprehensively sanctioned jurisdiction. Casita may suspend, cancel, or refuse any transaction, and may freeze or reverse any payout, where required to comply with applicable sanctions, anti-money-laundering, or counter-terrorist-financing laws.

Insurance. Casita is not an insurer and does not provide insurance to Guests or Hosts. Hosts and Guests are solely responsible for obtaining insurance sufficient to protect their properties, their guests, or their trip, as applicable. Casita disclaims liability for any damage or injury occurring during any reservation booked through the Services. We strongly recommend that Guests purchase comprehensive travel insurance.

14. Member Conduct

All Content, whether publicly posted or privately transmitted, is the sole responsibility of the person from whom it originated. You, and not Casita, are entirely responsible for all Content you upload, post, email, transmit, or otherwise make available via the Services.

Casita does not control Content posted via the Services and does not guarantee its accuracy, integrity, or quality. By using the Services you may be exposed to Content that is offensive, indecent, or objectionable. Under no circumstances will Casita be liable for any Content, including for any error or omission in it, or for any loss or damage of any kind incurred as a result of the use of any Content made available via the Services.

You agree not to use the Services to:

  • upload, post, email, transmit, or otherwise make available any Content that is unlawful, harmful, threatening, abusive, harassing, tortious, defamatory, vulgar, obscene, libelous, invasive of another's privacy, hateful, or racially, ethnically, or otherwise objectionable;

  • harm minors in any way;

  • impersonate any person or entity, including a Casita official, or falsely state or misrepresent your affiliation with a person or entity;

  • forge headers or otherwise manipulate identifiers in order to disguise the origin of any Content transmitted through the Services;

  • upload or make available any Content you do not have a right to make available under any law or under a contractual or fiduciary relationship, such as inside information or confidential information learned under an employment relationship or nondisclosure agreement;

  • upload or make available any Content that infringes any patent, trademark, trade secret, copyright, or other proprietary right of any party;

  • upload or make available any unsolicited or unauthorized advertising, promotional material, junk mail, spam, chain letters, pyramid schemes, or any other form of solicitation, except in areas designated for that purpose;

  • upload or make available any material containing software viruses or any other code, file, or program designed to interrupt, destroy, or limit the functionality of any software, hardware, or telecommunications equipment;

  • disrupt the normal flow of dialogue or otherwise act in a manner that negatively affects other users' ability to engage in real-time exchanges;

  • interfere with or disrupt the Services, or servers or networks connected to them, or disobey any requirement, procedure, policy, or regulation of networks connected to them;

  • use any robot, spider, scraper, or other automated means to access the Services, or to extract Content, including for the purpose of training any machine learning or artificial intelligence model, without our express written permission;

  • make false, speculative, or fraudulent bookings;

  • attempt to gain unauthorized access to any system, account, or user data;

  • violate any applicable local, state, national, or international law — including regulations relating to taxes, credit cards, data and privacy, permits or licensing, zoning ordinances, safety compliance, anti-discrimination, fair housing, export controls, technology transfers, currency controls, and human trafficking — or any applicable industry standard such as payment card network operating rules;

  • stalk or otherwise harass another user; or

  • collect or store personal data about other users.

Casita does not pre-screen Content, but Casita and its designees have the right, though not the obligation, in their sole discretion, to refuse, edit, or remove any Content available via the Services, including Content that violates these Terms or is otherwise objectionable. You must evaluate, and bear all risk associated with, the use of any Content, including any reliance on its accuracy, completeness, or usefulness.

Casita may preserve Content, and may disclose Content, where required by law or in the good faith belief that preservation or disclosure is reasonably necessary to comply with legal process, to enforce these Terms, to respond to claims that Content violates the rights of third parties, or to protect the rights, property, or personal safety of Casita, its users, and the public.

The technical processing and transmission of the Services, including your Content, may involve transmission over various networks and changes to conform to the technical requirements of connecting networks or devices.

License to your Content. Casita does not claim ownership of Content you submit. With respect to Content you submit or make available for inclusion in publicly accessible areas of the Services, you grant Casita a worldwide, royalty-free, non-exclusive, sublicensable license to use, store, copy, distribute, reproduce, modify, adapt, translate, publish, transmit, publicly perform, and publicly display that Content in connection with operating, marketing, and promoting the Services. You represent that you hold all rights necessary to grant this license.

15. Proprietary Rights

All parts of the Services, unless otherwise stated, are the exclusive property of Casita and are protected by copyright, trademark, and other intellectual property laws. Content created by Casita, its affiliates, or their contractors — including photography, videography, floor plans, copy, translations, and design — is and remains the exclusive property of Casita.

You may access, copy, download, and print material on the Website for your personal, non-commercial use, provided you do not modify or delete any copyright, trademark, or other proprietary notice. Any other use — including modification, distribution, transmission, performance, broadcast, publication, uploading, licensing, reverse engineering, transfer, sale, the creation of derivative works, or use of the Website for purposes competitive to Casita — is expressly prohibited.

Trademarks, logos, and service marks displayed on the Website are registered and unregistered marks of Casita, its licensors or content providers, or other third parties. All other trademarks, logos, and service marks are the property of their respective owners.

16. Copyright and DMCA

Casita respects the intellectual property of others and asks its users to do the same. Casita will review claims of copyright infringement it receives and will remove Content determined to have been posted or distributed in violation of applicable law.

If you believe your work has been copied in a way that constitutes copyright infringement, or that your intellectual property rights have otherwise been violated, provide the following: (i) an electronic or physical signature of a person authorized to act on behalf of the owner of the copyright or other intellectual property interest; (ii) a description of the work you claim has been infringed; (iii) a description of where the allegedly infringing material is located on the Website; (iv) your address, telephone number, and email address; (v) a statement that you have a good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law; and (vi) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright or intellectual property owner or authorized to act on the owner's behalf.

We reserve the right to send a copy of any such notice to a third party that may publish or annotate it.

Repeat infringers. Casita will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.

Casita may provide, or third parties may provide, links to other websites or resources, including content and links provided by advertisers. Casita has no control over such sites and resources, and your use of them is at your own risk. Casita is not responsible for their availability, does not endorse them, and is not responsible or liable for any Content, advertising, product, or other material on or available from them.

Casita will not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with the use of, or reliance on, any Content, goods, or services available on or through any such site or resource.

18. Modifications to the Service

Casita may at any time modify, suspend, discontinue, or terminate all or any part of the Services without notice. Casita may impose limits on Website usage, including how long Content is hosted, bandwidth used, and the number and duration of logins, and may terminate inactive accounts. Your use of the Services is at your own risk, and Casita has no responsibility or liability for your inability to use the Services or access any Content.

19. DISCLAIMER OF WARRANTIES

YOU EXPRESSLY UNDERSTAND AND AGREE THAT:

YOUR USE OF THE SERVICES IS AT YOUR SOLE RISK. THE SERVICES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. CASITA EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND ACCURACY, AND ANY WARRANTY ARISING FROM COURSE OF DEALING OR TRADE USAGE.

CASITA MAKES NO WARRANTY THAT (I) THE SERVICES WILL MEET YOUR REQUIREMENTS; (II) THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (III) THE RESULTS OBTAINED FROM USE OF THE SERVICES WILL BE ACCURATE OR RELIABLE; (IV) THE QUALITY OF ANY PRODUCT, SERVICE, INFORMATION, OR OTHER MATERIAL PURCHASED OR OBTAINED THROUGH THE SERVICES WILL MEET YOUR EXPECTATIONS; OR (V) ANY ERROR IN THE SOFTWARE WILL BE CORRECTED.

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF CERTAIN WARRANTIES. TO THE EXTENT SUCH EXCLUSIONS ARE PROHIBITED, THEY DO NOT APPLY TO YOU, AND NOTHING IN THESE TERMS LIMITS ANY NON-WAIVABLE STATUTORY RIGHT YOU MAY HAVE.

20. LIMITATION OF LIABILITY

TO THE FULLEST EXTENT ALLOWED BY APPLICABLE LAW, YOU EXPRESSLY UNDERSTAND AND AGREE THAT CASITA AND ITS AFFILIATES SHALL NOT BE LIABLE FOR (A) ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, HOWEVER CAUSED AND ON ANY THEORY OF LIABILITY, EVEN IF ADVISED OF THE POSSIBILITY; OR (B) ANY DAMAGES RESULTING FROM: (i) THE USE OF OR INABILITY TO USE THE SERVICES; (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES; (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICES, INCLUDING ANY HOST, GUEST, OR TRAVEL AGENT; (v) ANY INJURY, ILLNESS, DEATH, OR PROPERTY DAMAGE OCCURRING AT OR IN CONNECTION WITH ANY PROPERTY; (vi) ANY DELAY, DISRUPTION, OR FAILED TRANSACTION; OR (vii) ANY OTHER MATTER RELATING TO THE SERVICES.

WHERE OUR LIABILITY CANNOT BE EXCLUDED, YOU AGREE THAT OUR TOTAL AGGREGATE LIABILITY TO YOU IS NOT MORE THAN THE GREATER OF (a) THE TOTAL AMOUNT YOU PAID TO CASITA FOR THE AFFECTED RESERVATION, OR (b) ONE HUNDRED FIFTY U.S. DOLLARS (US$150). THIS CAP APPLIES IN THE AGGREGATE TO ALL CLAIMS AND IS NOT MULTIPLIED BY THE NUMBER OF CLAIMS, PROPERTIES, OR BOOKINGS.

THE PARTIES AGREE THAT THESE LIMITATIONS ARE AN ESSENTIAL BASIS OF THE BARGAIN AND REFLECT THE ALLOCATION OF RISK BETWEEN THEM, AND THAT THEY APPLY NOTWITHSTANDING THE FAILURE OF ANY LIMITED REMEDY OF ITS ESSENTIAL PURPOSE.

IF YOU ARE A RESIDENT OF A JURISDICTION THAT REQUIRES A SPECIFIC STATEMENT REGARDING RELEASE, THE FOLLOWING APPLIES. CALIFORNIA RESIDENTS MUST, AS A CONDITION OF THIS AGREEMENT, WAIVE THE APPLICABILITY OF CALIFORNIA CIVIL CODE SECTION 1542, WHICH STATES: "A GENERAL RELEASE DOES NOT EXTEND TO CLAIMS THAT THE CREDITOR OR RELEASING PARTY DOES NOT KNOW OR SUSPECT TO EXIST IN HIS OR HER FAVOR AT THE TIME OF EXECUTING THE RELEASE AND THAT, IF KNOWN BY HIM OR HER, WOULD HAVE MATERIALLY AFFECTED HIS OR HER SETTLEMENT WITH THE DEBTOR OR RELEASED PARTY." YOU HEREBY WAIVE THIS SECTION OF THE CALIFORNIA CIVIL CODE AND ANY SIMILAR PROVISION IN LAW, REGULATION, OR CODE THAT HAS THE SAME INTENT OR EFFECT.

NOTHING IN THESE TERMS EXCLUDES OR LIMITS LIABILITY FOR FRAUD, FRAUDULENT MISREPRESENTATION, OR WILLFUL MISCONDUCT, OR ANY OTHER LIABILITY THAT CANNOT BE EXCLUDED OR LIMITED UNDER APPLICABLE LAW.

21. Indemnity

You agree to defend, indemnify, and hold harmless Casita and its affiliates, and their respective officers, managers, members, directors, employees, contractors, and agents, from and against all losses, liabilities, expenses, damages, judgments, settlements, fines, penalties, and costs, including reasonable attorneys' fees and court costs, arising out of or relating to: your use of the Services, including any action taken by a third party using your account; your stay at, or your operation of, any Property; any damage caused by you or your occupants or visitors; and any violation by you of these Terms or of applicable law.

In the event of such a claim, suit, or action, we will attempt to provide notice to the contact information we have for your account, provided that failure to deliver such notice will not eliminate or reduce your indemnification obligations.

If you cause a technical disruption of the Website or of the systems transmitting it, you agree to be responsible for all losses, liabilities, expenses, damages, and costs, including reasonable attorneys' fees and court costs, arising from that disruption.

22. Notice and Electronic Communications

Unless we specify otherwise, communications between you and Casita are by electronic means. Casita may use a telephone call where it deems that necessary or convenient.

For contractual purposes, and for the normal performance of the Services, you (1) consent to receive communications from Casita in electronic form, and (2) agree that all terms, conditions, agreements, notices, disclosures, and other information Casita provides to you electronically satisfy any legal requirement that such communications be in writing. This does not affect your statutory rights.

Notices to you may be given by email, SMS, postal mail, or by posting in your account, and are deemed received on sending or posting. Casita may also provide notice of changes to these Terms or other matters by displaying notices or links to notices on the Services. You are responsible for keeping your contact details current.

23. Governing Law, Dispute Resolution, and Language

23.1 Governing law

These Terms are governed by the laws of the State of Maryland, United States, without regard to conflict-of-law principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply.

23.2 Informal resolution first

Casita is committed to customer satisfaction. If you have a problem or dispute relating to the Services or the Website (a "Claim"), we will try to resolve it. You agree to give us written notification of your Claim as set out in Section 22, stating (i) your name, (ii) your address, (iii) a written description of your Claim, and (iv) a description of the specific relief you seek.

If Casita does not resolve the Claim within sixty (60) days after receiving your notification (the "Resolution Deadline"), you may pursue the dispute as set out below. Casita will observe the same requirement before bringing a Claim against you.

23.3 Binding arbitration

After the Resolution Deadline, any Claim will be resolved by binding arbitration conducted in English in accordance with the Commercial Arbitration Rules and the Supplementary Procedures for Consumer-Related Disputes of the American Arbitration Association ("AAA"), as modified by this Section.

For any Claim where the total amount of the award sought is US$10,000 or less, you may instead bring the Claim in a small claims court in Baltimore, Maryland, or in the small claims court of the county in which you reside, provided the Claim remains in that court and is brought on an individual basis.

Unless the parties agree otherwise, the tribunal will consist of one arbitrator selected in accordance with AAA rules, who will be knowledgeable in the subject area of the dispute. Arbitration will be conducted by videoconference or on the basis of documents wherever practicable; any in-person hearing will take place in Baltimore, Maryland, or in another location the parties agree on. All discovery will be completed within sixty (60) days following the appointment of the arbitrator.

Each party is entitled to representation by counsel, to appear and present written and oral evidence and argument, and to cross-examine witnesses, provided that the arbitrator may receive testimony by telephone, video, or other electronic means. The arbitration award will be in writing, will be final and binding, and may be enforced in any court of competent jurisdiction. The parties waive any right to appeal the arbitrator's decision or award. The arbitrator may not award punitive or exemplary damages.

The prevailing party in any proceeding to enforce its rights under these Terms is entitled to recover reasonable attorneys' fees and other reasonable costs, including the fees of the arbitrator and the AAA, incurred in that proceeding.

Each party retains the right to seek judicial assistance: (i) to compel arbitration; (ii) to obtain interim measures of protection prior to or pending arbitration; (iii) to seek injunctive relief in any jurisdiction as necessary to protect against the unauthorized disclosure of proprietary or confidential information or of user data; (iv) for any claim of infringement or misappropriation of Casita's patent, copyright, trademark, or trade secret rights; and (v) to enforce any decision of the arbitrator, including the final award.

23.4 Class action waiver

ALL CLAIMS AND DISPUTES WITHIN THE SCOPE OF THESE TERMS MUST BE ARBITRATED OR LITIGATED ON AN INDIVIDUAL BASIS AND NOT ON A CLASS BASIS. CLAIMS OF MORE THAN ONE CUSTOMER OR USER CANNOT BE ARBITRATED OR LITIGATED JOINTLY OR CONSOLIDATED WITH THOSE OF ANY OTHER CUSTOMER OR USER. If this waiver of class or consolidated actions is held invalid or unenforceable, then neither you nor Casita is entitled to arbitration, and all claims and disputes will instead be resolved in court under Section 23.5.

23.5 Court proceedings

Where a Claim is not subject to arbitration — because the class action waiver is held unenforceable, or because the Claim falls within an exception in Section 23.3 — it must be brought exclusively in the state or federal courts located in Baltimore, Maryland, United States, other than a small claims action permitted under Section 23.3. You irrevocably submit to the personal jurisdiction and venue of those courts and waive any objection based on inconvenient forum. THE PARTIES WAIVE ANY RIGHT TO A TRIAL BY JURY.

23.6 Time limit

Regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to your use of the Services or these Terms must be filed within one (1) year after it arose, or be forever barred, to the extent permitted by applicable law.

23.7 Mandatory consumer protections

Nothing in this Section deprives a consumer of the protection of mandatory provisions of the law of their country or state of habitual residence where those provisions cannot be derogated from by agreement.

23.8 Language

English is the controlling language of these Terms. Any translation, including any Spanish version, is provided for convenience only and has no legal effect. In the event of any discrepancy, ambiguity, or conflict between versions, the English version prevails.

24. Force Majeure

CASITA SHALL NOT BE LIABLE FOR ANY DELAY OR FAILURE TO PERFORM RESULTING FROM CAUSES OUTSIDE ITS REASONABLE CONTROL, INCLUDING ACTS OF GOD, FIRE, FLOOD, EARTHQUAKE, STORM, NATURAL DISASTER, WAR, TERRORISM, CIVIL UNREST, RIOT, EMBARGOES, ACTS OF CIVIL OR MILITARY AUTHORITIES, GOVERNMENT ORDER, RESTRICTION, OR TRAVEL ADVISORY, EPIDEMIC, PANDEMIC, PUBLIC HEALTH EMERGENCY, LABOR DISPUTE, FAILURE OF UTILITIES, TELECOMMUNICATIONS, INTERNET, HOSTING, OR THIRD-PARTY SERVICES, CYBERATTACK INCLUDING DENIAL-OF-SERVICE AND RANSOMWARE, OR SHORTAGES OF TRANSPORTATION FACILITIES, FUEL, ENERGY, LABOR, OR MATERIALS.

Refunds in these situations are governed by the applicable Cancellation Policy and are not guaranteed. You are strongly encouraged to purchase comprehensive travel insurance.

25. International Users

Casita makes no representation that materials on this Website are appropriate or available for use in all locations. If you access this Website from outside the United States, the Website may contain references or links to products and services that are not available or are prohibited in your jurisdiction.

Any user resident outside the United States agrees that (i) they have voluntarily sought and established contact with Casita; (ii) they will not use, transmit, disseminate, or upload any material or content that would violate applicable laws or regulations of their country of residence; (iii) their participation is governed by the law and dispute resolution provisions in Section 23; and (iv) they consent to having their data processed in the United States and in Mexico, subject to our Privacy Policy and to Section 23.7.

26. For Residents of Quebec / Pour les résidents du Québec

The parties declare that they have required that these Terms of Service and all documents related hereto, either present or future, be drawn up in the English language only.

Les parties déclarent par les présentes qu'elles exigent que cette entente et tous les documents y afférents, soit pour le présent ou l'avenir, soient rédigés en langue anglaise seulement.

27. California Residents

Pursuant to California Civil Code section 1789.3, Casita provides the following information.

Charges imposed by the provider for use of the service: As set out in Section 11, Casita may charge Guests a service fee on reservations and on additional services booked through the platform, and charges Hosts a commission on confirmed reservations.

Procedures to resolve a complaint or receive further information: A consumer may follow the procedure set out in Section 23.2. A consumer may also contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210 or (916) 445-1254.

28. Mobile Applications

Where Casita makes a mobile application available, we grant you a limited, revocable, non-exclusive, non-transferable license to install and use it on a device you own or control, solely for your personal use of the Services and subject to these Terms and to the rules of the app store from which you obtained it. You may not copy, modify, reverse engineer, decompile, or create derivative works of the application, or rent, lease, lend, sell, or sublicense it.

For applications obtained from the Apple App Store: these Terms are between you and Casita only, not Apple, and Casita alone is responsible for the application and its content. Apple has no obligation to provide any maintenance or support for the application. Casita, not Apple, is responsible for addressing any claim relating to the application, including product liability claims, any claim that the application fails to conform to a legal or regulatory requirement, and any claim arising under consumer protection or similar legislation, and Casita is responsible for the investigation, defense, settlement, and discharge of any third-party claim that the application infringes intellectual property rights. You represent that you are not located in a country subject to a U.S. Government embargo or designated as a terrorist-supporting country, and that you are not listed on any U.S. Government list of prohibited or restricted parties. Apple and its subsidiaries are third-party beneficiaries of these Terms and have the right to enforce them against you. Equivalent acknowledgments apply to Google and to any other app store operator from which you obtain the application, and each such operator is a third-party beneficiary of these Terms to the extent required by its rules.

29. General

These Terms, together with any Booking Agreement you accept and the policies incorporated by reference above, constitute the entire agreement between you and Casita and govern your use of the Services, superseding all prior agreements, discussions, proposals, and representations between you and Casita on their subject matter, including the CasitaMX Terms of Use dated July 7, 2025. You may also be subject to additional terms that apply when you use affiliate services, third-party content, or third-party software.

Order of precedence. A Booking Agreement controls over these Terms only as to the specific commercial terms of the reservation it expressly addresses — such as dates, rates, occupancy, payment schedule, and reservation-specific rules — and only where it is presented or approved in writing by Casita. Sections 3, 5, 19, 20, 21, 22, 23, and 29 of these Terms control over any Booking Agreement in all cases and may not be varied by it. These Terms control over the policies incorporated by reference.

No change to Casita's role. A Booking Agreement records terms between you and Casita relating to your use of the Services and your payment for a reservation. It does not make Casita a party to the contract for the stay, which is at all times between you and the Host, and does not make Casita the owner, operator, manager, lodging provider, landlord, or insurer of any Property. Nothing in a Booking Agreement is to be construed as varying Section 3.

Relationship of the parties. Nothing in these Terms creates a joint venture, partnership, franchise, employment, or agency relationship between you and Casita, other than the limited payment collection agency described in Section 7.4. Casita is an independent service provider and is not responsible for the acts or omissions of Hosts, Guests, or Travel Agents.

No third-party beneficiaries. Except for the indemnified persons under Section 21 and the app store operators identified in Section 28, these Terms confer no rights on any third party.

Waiver and severability. No waiver is effective unless in writing, and waiver of one provision or on one occasion does not waive any other. If any provision of these Terms is found by a court or arbitrator of competent jurisdiction to be invalid or unenforceable, it will be modified to the minimum extent necessary to give effect to the parties' intentions, or severed, and the remaining provisions remain in full force and effect.

Assignment. You may not assign or transfer these Terms, by operation of law or otherwise, without Casita's prior written consent. Any attempt to do so without consent is null and void. Casita may assign or transfer these Terms freely, in whole or in part, including to an affiliate or in connection with a merger, reorganization, or sale of assets. Subject to the foregoing, these Terms bind and inure to the benefit of the parties, their successors, and permitted assigns.

Survival. Sections 1, 5 (as to damage), 11, 12, 14 (as to the license to your Content), 15, 19, 20, 21, 22, 23, and 29 survive termination of these Terms or of your account, together with any provision that by its nature is intended to survive. Termination does not affect rights or liabilities accrued before it.

Electronic acceptance. These Terms may be accepted electronically, and Casita's records are conclusive evidence of your acceptance and of the version accepted, absent manifest error.

Headings. Section headings are for convenience only and do not affect interpretation.
